Terms of Sale

These Terms of Sale and Use (the "Terms") are entered into between ECOM BLUE, a French simplified joint-stock company (SAS) with a share capital of €1,000, registered with the Paris Trade and Companies Register under number 945 138 949, whose registered office is at 149 Avenue du Maine, 75014 Paris, France, trading under the name "Blokk" (hereinafter "Blokk", "we", "us"), and any person who visits or makes a purchase on the website blokkbricks.com (the "Site"), hereinafter the "User". Any visit to or purchase on the Site implies full acceptance of these Terms.

Definitions

Customer: any User who places an Order on the Site.
Order: the process by which the Customer selects Products, chooses delivery options and completes payment.
Product: any item displayed or sold on the Site, in particular Blokk brick-built botanical sets.
User: any person accessing the Site, whether or not a Customer.
Site: blokkbricks.com and all related pages.

1. Purpose and scope

These Terms define the conditions under which Users may access and use the Site and purchase Products. By visiting any part of the Site or purchasing a Product, each User agrees without reservation to these Terms. New features or Products added after the publication date of these Terms are also subject to them.

2. Current version

The version of the Terms that applies is the latest version published on the Site. Blokk may update, change or replace any part of these Terms at any time to reflect legal, regulatory or technical developments. Each Order is governed by the Terms in force on the date of that Order. Continued use of the Site after changes are published constitutes acceptance of the new Terms.

3. Use of the Site

The Site is hosted on Shopify Inc., which provides the e-commerce platform allowing Blokk to present and sell its Products.

By accepting these Terms, the User confirms that they are of legal age in their province or country of residence, or that they have the consent of a parent or guardian. Blokk sets are recommended for ages 8 and up; they contain small parts and should be kept away from very young children.

The User agrees not to use the Site for any unlawful purpose and not to interfere with its operation (viruses, malicious code, scraping, attempts to bypass security measures). Blokk may interrupt or suspend the Site, in whole or in part, at any time without notice.

4. General conditions

Blokk reserves the right to refuse service to anyone, to limit sales to any region or jurisdiction, to limit quantities per person, per household or per Order, and to stop offering any Product at any time. Product descriptions and prices may be changed at any time without notice. Any offer is void where prohibited by law.

5. Prices

Prices are displayed in Canadian dollars (CAD). Applicable sales taxes (GST/HST/PST/QST) are calculated and shown at checkout according to the delivery address. The price charged is the price displayed on the Site at the time of the Order. Prices may change without notice, for example due to changes in material or logistics costs; such changes do not affect Orders already placed.

6. Product presentation

Product photographs and renderings are as accurate as possible, but Blokk cannot guarantee that Products will be exactly identical to the images, notably because of screen differences. Piece counts, dimensions and build times are given as indications. The Site may contain typographical errors or omissions regarding descriptions, prices, promotions or availability; Blokk reserves the right to correct them and to cancel an Order based on inaccurate information, including after it has been placed, in which case the Customer is refunded in full.

7. Orders

The User may browse the Site without any obligation to buy. To place an Order, the Customer adds Products to the cart and completes checkout; no account is required. The Order is final once payment has been received by Blokk, and a confirmation email is sent to the address provided. A finalized Order that has already been dispatched cannot be cancelled; it may be returned under Section 9.

Orders are dispatched within 1 to 3 business days. A tracking link is sent by email as soon as the parcel is on its way; the Customer should check their spam folder if it is not received. Blokk honours Orders within the limit of available stock and may refuse or cancel an Order in case of stock shortage, suspected fraud, orders that appear to come from resellers, or force majeure. The Customer is informed by email in such cases and refunded.

The Customer agrees to provide accurate and complete order and contact information. Blokk cannot be held responsible for a delivery failure caused by an incorrect address.

8. Shipping and delivery

Shipping is free across Canada. Delivery takes 5 to 8 days after dispatch. Blokk currently ships to Canada only.

Blokk relies on third-party carriers. Delivery times are given as indications and may be extended by carriers, customs, weather or other events outside Blokk's control, without this giving rise to compensation. A short delay during periods of high demand may extend dispatch by a few business days.

The carrier's tracking record showing delivery is proof of receipt between the parties. If the tracking shows the parcel as delivered but the Customer has not received it, the Customer must contact Blokk within 7 days at contact@blokkbricks.com so that we can open an investigation with the carrier and, where appropriate, resend the Products at no extra cost.

9. Returns and refunds

The Customer has 30 days from the date of delivery to return a Product, without having to give a reason. To be accepted, the Product must be unused, unbuilt, with all sealed bags intact and in its original packaging. To start a return, write to contact@blokkbricks.com with the order number; we reply with the return instructions. Return shipping costs are borne by the Customer, except where the Product is defective or an error was made by Blokk.

Once the returned Product is received and checked, Blokk refunds the amount paid using the original payment method within 14 days. A Product returned opened, partly built, damaged or incomplete cannot be refunded.

10. Missing or defective pieces

If a set arrives with missing or damaged pieces, Blokk replaces them free of charge. Write to contact@blokkbricks.com with the order number and the piece reference shown in the booklet; replacement pieces are sent at no cost. If a Product is defective, the Customer should contact us with photos within a reasonable time after delivery so that we can replace it or refund it.

11. Legal warranties

Blokk is bound by the legal warranty of conformity and the warranty against hidden defects provided by applicable law, as well as by the consumer protection legislation of the Customer's province of residence, to which these Terms do not derogate. The warranty does not cover damage resulting from misuse, modification, improper handling or storage of the Product by the Customer or a third party.

12. Limitation of liability

Blokk cannot be held liable for non-performance of its obligations when it results from the act of a third party, the Customer's fault, or force majeure. The Site and Products are provided "as is" and "as available". To the fullest extent permitted by law, Blokk, its officers, employees, affiliates, suppliers and service providers shall not be liable for indirect or consequential damages (loss of profit, data or business) arising from the use of the Site or Products. Where applicable law does not allow such limitations, Blokk's liability is limited to the maximum extent permitted.

13. Third-party links and tools

The Site may contain links to or tools from third parties over which Blokk has no control. They are provided "as is", without warranty. Blokk is not responsible for the content, products or practices of third-party websites, and any complaint concerning them must be addressed to the third party.

14. User comments

If a User sends Blokk comments, ideas, suggestions or reviews, Blokk may use, edit, publish and distribute them in any media without compensation or obligation of confidentiality. Blokk may remove any content it considers unlawful, offensive or infringing. The User is solely responsible for the comments they publish and agrees not to use a false identity or email address.

15. Personal data

The processing of personal data is governed by our Privacy Policy.

16. Intellectual property

The Blokk name and logo, the Site, its texts, images, videos and designs are the property of ECOM BLUE or its licensors and are protected by intellectual property laws. Any reproduction or use without prior written consent is prohibited. Blokk is an independent brand; it is not affiliated with, sponsored by or endorsed by any other building-brick manufacturer.

17. Prohibited uses

The User agrees not to use the Site or its content for any unlawful purpose, to infringe the rights of Blokk or third parties, to publish false or defamatory information, to collect personal data of others, to spam, phish, crawl or scrape the Site, or to circumvent its security measures.

18. Indemnification, severability, waiver, termination

The User agrees to indemnify and hold Blokk and its affiliates, officers and service providers harmless against any third-party claim arising from a breach of these Terms. If any provision of these Terms is found to be unlawful or unenforceable, it shall be severed and the remaining provisions shall remain in force. Blokk's failure to exercise a right under these Terms shall not constitute a waiver of that right. Obligations incurred before termination survive it. Blokk may terminate access to the Site at any time if it suspects a breach of these Terms.

19. Governing law and disputes

These Terms are governed by French law, without prejudice to the mandatory consumer protection rules of the Customer's province or country of residence. In the event of a dispute, the Customer is invited to contact Blokk first at contact@blokkbricks.com so that an amicable solution can be found. Failing that, the dispute may be brought before the competent courts.
